Terms & Conditions

 

  1. BOOKING TERMS: By progressing past the webpage on which these terms appear by selecting “Submit”, you agree to the terms and conditions below with Go Golfing Pty Ltd (“Go Golfing”) and that they are legally binding having agreed to them by electronic means (“Booking Terms”). You represent and warrant that you are authorised and have the capacity to accept these Booking Terms. These Booking Terms may include the booking of a tour (“Tour”) or tournament (“Tournament”) conducted by Go Golfing for your benefit as consideration for the fees paid to do so described herein.

 

  1. BOOKING ON BEHALF OF A GROUP: If you are booking on behalf of a third party, you represent and warrant that you are authorised to accept these Booking Terms on behalf of those you are booking on behalf of and that you will ensure they are legally bound by these Booking Terms.

 

  1. TOURNAMENT RULES: For each Tournament, specific rules will apply to the competition that will be communicated by Go Golfing when appropriate (“Tournament Rules”). Go Golfing and their nominated representatives will have absolute discretion regarding rulings and any disputes regarding the Tournament Rules and how they apply.

 

  1. DEPOSITS AND FINAL PAYMENTS:  An initial deposit in accordance with the communication from Go Golfing and the Itinerary must be paid prior to any confirmation of the booking. Final payment (including optional extras) pursuant to the Go Golfing statement of account (“Statement of Account”) will be required prior to the 1st day of the month prior to the Departure Date of your Tour/Tournament. Should full payment not be received before the final payment due date as communicated by Go Golfing, your booking may be cancelled without notice. Go Golfing has the right to re-calculate Tour/Tournament costs to reinstate your booking, and late payment fees may apply at the discretion of Go Golfing. For cancellations, refunds are subject to the Cancellation/Refund Terms described below.

 

  1. CHANGES IN ITINERARY & FORCE MAJEURE: Go Golfing endeavours to perform all Tour/Tournaments according to the published Itinerary, but reserves the right to change or substitute where necessary for reasons outside of our control including but not limited to: acts of nature, road and or weather conditions, local holidays, strikes, war, civil disturbances, pandemic (e.g. COVID-19 or a variant of the same) advice by government authorities, breakdowns, medical or customs regulations, alternations, cancellations, delays, tender unavailability or golf course cancellations, we will substitute (at the nearest possible standard) an alternative where possible.

 

  1. TOUR/TOURNAMENT COSTS: Prices are based on per person, twin/double room or single room and set at the discretion of Go Golfing. In the event of currency fluctuations, increase in supplier costs or government taxes, Go Golfing reserves the right to re-cost your package cost. Go Golfing package pricing includes all items and services described in the itinerary for the relevant Tour/Tournament published at the time of booking (“Itinerary”). All other costs associated with the Tour/Tournament are payable by you in addition including but not limited to local tipping, airfares, visas, airport taxes, port taxes, security charges, airport transfers, items of a personal nature, laundry, drinks and consumables.

 

  1. HEALTH & FITNESS: A good level of health & fitness is required to participate in activities promoted by Go Golfing as included in the Tour/Tournament. It is your responsibility to advise Go Golfing of any pre-existing medical condition that may affect the normal conduct of the Tour/Tournament & enjoyment of others during the same. While Go Golfing does not have the responsibility to customise a Tour/Tournament for any single person’s benefit, in the case you have a medical condition that may require further efforts to book services or modify activities, Go Golfing will always assist however it can. Such modified activities may involve further costs payable by you.

 

  1. RESPONSIBILITY: Go Golfing acts only as a booking agent making reservations with the companies or associates offering the services contained in this Itinerary. Whilst acting in good faith, Go Golfing does not accept any responsibility for default causing loss or injury to person or property whether by negligence or otherwise on the part of an operator, ground-tour manager or other third parties involved or their representatives, employees, agents or contractors. Go Golfing has made every endeavour to communicate effectively and ensure that all details are correct at the time of proposing the Tour/Tournament but does not accept responsibility for subsequent changes or withdrawal of prices, details or services shown.

 

  1. SOLO TRAVELLERS: On request, Go Golfing will assist with sourcing a room share partner of the same sex. You will be charged the single supplement amount until a room share partner is found, then the single supplement charge will no longer be payable. In the case a room share cannot be found, the single supplement will be charged. Should you be ‘matched’ with another person we cannot be held responsible if the choice is not to your satisfaction. You agree that should Go Golfing be required to book another room because of your behaviour towards the person allocated to your room share, you will be liable for that cost at the absolute discretion of Go Golfing.

 

  1. AIRFARES & TAXES:  Any airfares noted as included in the Tour/Tournament itinerary are based on economy airfares available at the time of booking. Personal preferences are not always available. Upgrades are subject to availability and at an additional cost. Airfares are subject to increases until the tickets have been issued and paid in full, even if communicated by Gol Golfing at any time. Once your deposit has been paid in full and the internal airfare sectors have been ticketed by Go Golfing there will be no further increase in internal airfares and or taxes. International airfares are not included in the Itinerary; however, we can assist with all of your international travel arrangements. All airfare bookings are subject to individual airline terms and conditions, including baggage requirements so contact the relevant airline to assist with any queries or issues.

 

  1. PORTERAGE: Hotel porterage for one suitcase and one set of golf clubs per person is included at each stay during your Tour/Tournament. Porterage is not included for pre or post your Go Golfing booking. It is not included on the first or last days of your Tour/Tournament when arriving or departing your hotel independently.

 

  1. LUGGAGE LIMITS: Each passenger is entitled to take one suitcase and + a golf bag. Extra porterage charges may be imposed to cover handling costs for any additional luggage. Airlines have their own luggage restrictions, please check with each airline individually based on your booking class. If you do not adhere to these limitations excess baggage fees may apply and will be your own expense.

 

  1. VISAS & PASSPORTS: All passengers must have a passport that is valid for at least six months after their return date to Australia. Passengers are solely responsible for meeting necessary passport and visa entry requirements and paying all associated costs. Go Golfing is not responsible, nor accepts liability, for any traveller refused entry due to carrying or presenting incorrect documentation to customs or border officials. Visas, including transit visas, are the passenger’s own responsibility. For more information please log on to: dfat.gov.au or www.smarttraveller.gov.au. Please check with the respective Embassy or Consulate of each country that you are travelling to, as many destinations require visas for both Australians and non-Australian passport holders.   1. SPECIAL DIETARY REQUESTS: Please note requests for special dietary requirements cannot be guaranteed at all hotels and restaurants however, best efforts are made to ensure suitable meals for all Tour/Tournament guests.

 

  1. PAYMENT: Payment can be made by cheque – make cheques payable to Go Golfing Pty Ltd, via Direct Deposit into our bank account (see booking for bank details), with Mastercard and Visa credit card (a 1.55% credit card surcharge applies) and Amex (a 3.25% surcharge applies).

 

  1. CANCELLATION & REFUNDS: Cancellation requests must be provided in writing. Go Golfing will act on your behalf to recoup any deposits/payments paid to suppliers as permitted within the contract terms. Go Golfing will refund all monies paid LESS non-refundable expenses committed to for your Tour/Tournament plus:
  • Up to 60 days out from Tour/Tournament – AUD $150 (for Tournament) or AUD $250 (for Tour) + any/all non-refundable expenses as per our contract(s) with suppliers
  • From 30 days to 59 days out from Tour/Tournament – Full initial deposit
  • Less than 30 days out from Tour/Tournament – Full initial deposit + any/all non-refundable expenses as per our contract(s) with suppliers

 

The above only represents Go Golfing cancellation fees. Airlines and our suppliers may have additional cancellation fees. There is no refund for unused services or if portions of the holiday package are missed. Refunds for any pre, post or optional packages added to your booking will be subject to the refund policies of the relevant suppliers.

 

  1. DISPUTE RESOLUTION: You agree that should there be a disagreement or dispute raised between you and any third party including another Tour/Tournament client, Go Golfing will have absolute discretion and authority to resolve the same and you will comply with those directions.

 

  1. MOTORISED CARTS: To drive a motorised cart, you agree to possess a current driver’s license, have previous experience driving a golf cart equal to a minimum of four rounds and comply with the rules of the applicable venue, course or establishment. In the event you cause, or partially cause, an incident resulting in personal or property damage, you are responsible for the costs to repair the cart and any property damaged as well as being liable for any personal injury claims and fully indemnify Go Golfing for any liability, loss or damage you cause.

 

  1. LIABILITY: Further to any liability you assume otherwise, including by venues, courses or establishments during a Tour/Tournament, you agree that you travel and participate at your own risk. Go Golfing and its employees, contractors, representatives, hosts and other suppliers of goods and services accept no liability for any death, injury, property loss or damage incurred during or arising out of any aspect of the conduct of this Tour/Tournament and you fully indemnify the same from any and all damage, loss or claim made in relation to your act or omission.

 

  1. INSURANCE: It is a condition of your booking that you are adequately insured for your Tour/Tournament whether that be insurance applicable to health, travel or otherwise. We recommend you take out adequate insurance at the time of booking to protect yourself from anything that may occur during a Tour/Tournament. You must have access to a copy of your certificate of insurance while travelling. Go Golfing will provide assistance with any insurance claim you need to make to your insurer.

 

  1. IMAGE CONSENT: By agreeing to these terms, you consent to the use of my image in photographs or recordings (audio and video) taken at the event for use in the advertising, marketing or promotion of the event or any other event being conducted by Go Golfing. I also assign all rights, titles, and interest in any and all photographs, motion pictures, recordings or other records of me (or taken by me) during the Tour/Tournament to Go Golfing.   1. Governing Law; Jury Trial Waiver. The Booking Terms and all disputes arising hereunder and/or relating hereto shall be governed by and construed in accordance with the laws of the State of Queensland, Australia, without reference to any principles of conflict of laws.  Each of the parties hereto irrevocably waives all right to trial by jury in any action, proceeding or counterclaims arising out of or relating to the Agreement.

 

  1. The parties agree that in relation to any dispute relating to these Booking Terms an attempt must first be made to resolve it through final and binding arbitration conducted by an arbitrator in Gold Coast, QLD, and administered by the Institute of Arbitration and Mediation of Australia (“IAMA”) in accordance with the then existing commercial rules of IAMA. Judgment upon the matter and any award rendered will be final and binding.

 

  1. No Waiver. No waiver of any right or remedy in respect of any occurrence or event on one occasion shall be deemed a waiver of such right or remedy in respect of such an occurrence or event on any other occasion.

 

  1. Integration. The Booking Terms and any exhibits and schedules attached thereto constitute the entire understanding of the parties with respect to the subject matter of the Booking Terms and supersede all prior agreements, proposals and representations, written or oral, between the parties relating to the subject matter of the Booking Terms.

 

  1. The paragraph headings appearing in the Booking Terms are inserted only as a matter of convenience and in no way define, limit, construe or describe the scope or extent of such paragraph or in any way affect such paragraph.

 

  1. Counterparts. The Booking Terms may be executed by facsimile and/or PDF and in several counterparts, each of which shall be deemed an original for any purpose, and all of which taken together shall constitute one single agreement between the parties.

 

  1. Interpretation. The following rules of interpretation apply unless the context requires otherwise:  (i) the singular includes the plural and conversely; (ii) where a word or phrase is defined, its other grammatical forms have a corresponding meaning; (iii) a reference to a person includes a body corporate, an unincorporated body or other entity and conversely; and (iv) all references herein to dollars or $ are to Australian dollars.

 

  1. Attorneys Fees and Costs. In the event of any dispute, arbitration or litigation arising in any manner with respect to the Booking Terms, the prevailing party shall be entitled to its reasonable attorney’s fees and costs, in addition to any other award.

 

  1. Further Documents. The parties shall execute and deliver such other documents consistent with the Booking Terms that are reasonably deemed necessary to carry out the intent and purpose of the Booking Terms.

 

  1. No Additional Terms. No additional terms contained in any invoice, other correspondence, or written or oral communication between the parties will be binding on a party and such additional or conflicting terms are deemed rejected by the parties unless such terms are contained in an amendment to the Booking Terms, or other written agreement executed by both Parties.
